LECC Report into investigation of NSWPF officer using excessive or unreasonable use of force during arrest of female civilian
The Law Enforcement Conduct Commission furnished its report in Operation Kadenwood to Parliament today.
The investigation found that a NSW Police Force officer, in striking and restraining a female civilian during her arrest, by forcibly placing his hand around her throat, was an unreasonable use of force.
Private hearings were conducted by the Commission in December 2020. Four officers who were involved in the arrest of the female civilian gave evidence relating to the arrest. Video footage from the body worn camera of one of the officers capturing the incident was shown to the officers and they were questioned about the arrest. That video footage is to be viewed in conjunction with the report.
Findings
The Commission has found that the officer engaged in serious police misconduct and recommended that consideration be given to the taking of non-reviewable action pursuant to section 173 of the Police Act 1990.
