Media Release - Operation Mantus Notice of Public Hearing

The Law Enforcement Conduct Commission (the Commission) will hold a public hearing commencing at 10:00am on Monday, 3 April 2023 and continuing until Thursday 6 April 2023 (inclusive).

The investigation relates to allegations NSW Police used excessive force during the apprehension of a young person on 11 September 2022.

Systemic issues within the NSW Police Force have arisen out of this incident, and they will form part of the Commission’s investigation known as Operation Mantus. These systemic issues include the role of the custody manager who is responsible for people in custody;  interviewing by Police of people after those people have received legal advice not to be interviewed; and the use of body worn video. 

The upcoming public hearing is a further part of the investigation which follows evidence being taken at a series of private examinations held in the week of 13 March 2023.

The public hearing will commence with Counsel Assisting advising of the current status of the investigation, and summarising certain aspects of the evidence taken during the private examinations. 

In addition to the systemic issues within the NSW Police Force, the public hearing will touch upon the apprehension of the young person.

The public hearing will be held at the Commission’s hearing room, Level 3, 111 Elizabeth Street, Sydney.

Mobile phones will be allowed in the hearing room.

Filming and recording will not be allowed in the hearing room or in Commission premises.

The public hearing will not be live streamed. The transcripts and video recording of each day of the public hearing will be made available on the Commission’s website generally within 24 hours.

Background

The Law Enforcement Conduct Commission is an independent statutory body. The principal functions of the Commission are to detect, investigate and expose serious misconduct and serious maladministration within the NSW Police Force.
