The Law Enforcement Conduct Commission is conducting an investigation into whether the arrest and charging of a male person by New South Wales Police Force (NSWPF) officers in Condobolin in May 2014 and the withdrawal of charges in February and March 2015; and the enforcement by NSWPF officers of bail granted to the individual in May and July 2014, was or concerned serious misconduct and/or unlawful, unreasonable, unjust or oppressive conduct or arose, wholly or in part from a mistake of fact or law.

NOTICE OF PUBLIC HEARING

The Law Enforcement Conduct Commission will hold a public hearing at 10am on Monday 9 September 2019 regarding the arrest and charging of a male person, the enforcement by NSW Police officers of bail granted to that person, and bail enforcement practices more generally.

The public hearing, part of Operation Cusco, will be held at the Commission’s hearing room, level 3, 111 Elizabeth Street, Sydney. The hearing is expected to run for two days, Monday 9 September 2019 and Wednesday 11 September 2019.

The general scope and purpose of the hearing will be:

Whether the arrest and charging of a male person by New South Wales Police Force (NSWPF) officers in Condobolin in May 2014 and the withdrawal of charges in February and March 2015; and the enforcement by NSWPF officers of bail granted to the individual in May and July 2014, was or concerned serious misconduct and/or unlawful, unreasonable, unjust or oppressive conduct or arose, wholly or in part from a mistake of fact or law.

Whether the rules, orders or practice of the NSWPF either generally or at particular stations or commands concerning the imposition and enforcement of bail conditions are or could be indicative of a pattern of unlawful, unreasonable, unjust or oppressive conduct or arose, wholly or partly from a mistake of fact or law or systemic issues that could adversely reflect on the integrity and good repute of the NSWPF.TtT

Background

The Law Enforcement Conduct Commission is an independent statutory body. The principal functions of the Commission are to detect, investigate and expose serious misconduct and serious maladministration within the NSW Police Force.

The Commission is separate from and completely independent of the NSW Police Force. The Commission will treat all information confidentially and has powers to protect persons who provide information to it.
